AMERICAN DENTAL SOLUTIONS SOCIAL MEDIA PROMOTION OFFICIAL RULES, TERMS AND CONDITIONS
NO PURCHASE IS NECESSARY TO PLAY OR WIN A PRIZE. A PURCHASE WILL NOT IMPROVE CHANCES OF WINNING. BY PARTICIPATING, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT. WITHOUT LIMITATION, THIS CONTRACT INCLUDES INDEMNITIES TO THE SPONSOR (DEFINED BELOW) FROM YOU AND A LIMITATION OF YOUR RIGHTS AND REMEDIES.
1. Eligibility: The American Dental Solutions Social Media Sweepstakes (the “Promotion”) is open to persons of any age. The Promotion is only open to legal residents of Pennsylvania and is void where prohibited by law. Employees of American Dental Solutions (the “Sponsor”) their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Promotion. The Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited.
2. Agreement to Rules: By participating, you agree to be fully and unconditionally bound by these Official Rules, Terms and Conditions (the “Rules”) and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of American Dental Solutions, as final and binding as it relates to the Promotion. The Promotion is subject to all applicable federal, state and local laws.
3. Promotion Period: Entries will be accepted via the AMOE (defined below) or at every participating American Dental Solutions location during their office hours or at the mail in address listed starting at 12:01am on November 26, 2014 and ending at 11:59 pm on February 28, 2015 or while supplies last. Entries via the AMOE must be received by the Sponsor no sooner than 12:01am on November 26, 2014 and no later than 11:59 pm on February 28, 2015.
4. How to Enter:
a. At time of appointment at any participating location of the Sponsor, posting 1 of any 3 valid social media functions and showing it to an American Dental Solutions’ receptionist or other authorized employee and/or agent (as described in section 16 below). Upon the Sponsor’s acceptance of such entry, the participant will receive a Ticket (defined below);
b. By mailing visual proof of 1 of 3 valid social media functions (as described in section 16 below) along with an adequately stamped, self-addressed envelope to American Dental Solutions Media Promotion, 1301 Penn Ave., Wyomissing, Pa 19610 (the “AMOE”). Upon the Sponsor’s acceptance of such entry, the participant will receive a Ticket (defined below). NO PURCHASE NECESSARY TO ENTER. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.
The entry must fulfill all Promotion requirements, as specified herein, to be eligible to receive a Ticket (defined below). Entries that are not complete, not accurate, or do not adhere to the Rules or specifications may be disqualified at the sole discretion of American Dental Solutions. For in-office entries, you may enter only once per day. For mail in entries via the AMOE, you may only mail-in one entry per day. Entering more times than indicated by using multiple entries, identities or devices in an attempt to
circumvent the Rules will forfeit your entry. If you use fraudulent methods or otherwise attempt to circumvent the Rules your submission may be removed from eligibility at the sole discretion of American Dental Solutions.
5. Winner Selections: Winners of the Promotion will be determined at random through the use of scratch off tickets (each a “Ticket” and collectively, the “Tickets”) distributed at the rate of one Ticket per valid entry under the supervision of the Sponsor. Winners will be identified by a Ticket revealing a $500 symbol in the scratch off section of the Ticket. If the winner is under 18, then the participant’s parent/guardian/family member can claim the prize. American Dental Solutions shall have no liability for a winner’s failure to recognize a winning symbol. Prizes will be made available for pick up at any participating American Dental Solutions location on the next business day of that location following the confirmation of a winning ticket by the Sponsor. If the winner fails to claim the prize within 15 days from the time of confirmation of the winning ticket or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited. The receipt by the winner of the prize offered in this Promotion is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
6. Odds: The odds of winning depend on the number of eligible entries received and, accordingly, the number of Tickets issued, but are approximately one in five hundred. The number of Tickets available and prizes available at the beginning of the Promotion will decrease as the Promotion proceeds and the Tickets are distributed and prizes are claimed.
7. Prizes: Winners of the Tickets will receive a $500 Visa or MasterCard gift card. Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor’s discretion. The prize is nontransferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for American Dental Solutions to use winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
8. Rights Granted by you: By entering the Promotion, you understand and agree that American Dental Solutions, anyone authorized to act on behalf of American Dental Solutions, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent, to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Promotion, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
9. Terms: American Dental Solutions reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Promotion should (in its sole discretion) an unauthorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Promotion. In such case, American Dental Solutions may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by American Dental Solutions. American Dental Solutions reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or violates the Rules. American Dental Solutions has the right, in its sole discretion, to maintain the integrity of the Promotion, to void entries for any reason, including, but not limited to; multiple entries from the same participant in violation of these Rules; multiple entries from the same device in excess of that allowed by the Rules.
By entering the Promotion, you agree to receive emails and social media posts periodically from American Dental Solutions. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the email or unfollowing American Dental Solutions on social media. In addition, you (a) agree to comply with all terms and conditions of Twitter, Instagram and Facebook, and (b) acknowledge that the Promotion is no way affiliated with or endorsed by Twitter, Instagram and/or Facebook.
10. Limitation of Liability: By entering the Promotion, you agree to release and hold harmless American Dental Solutions and its subsidiaries, affiliates, advertising and promotion agencies, shareholders, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, and/or (ii) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
11. Disputes: THIS PROMOTION IS GOVERNED BY THE LAWS OF THE COMMONWEALTH OF PENNSYLVANIA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Promotion, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Berks County, Pennsylvania having jurisdiction. Further, in any such dispute, under no circumstances will the participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than the participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Promotion), and participant further waives all rights to have damages multiplied or increased.
12. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the American Dental Solutions Web Site. www.americandentalsolutions.net
13. Winners List: To obtain a copy of the winner’s name or a copy of these Rules, mail your request along with a stamped, self-addressed envelope to: American Dental Solutions, 1301 Penn Ave., Wyomissing, PA 19610. Requests for a list of winners must be received no later than 30 days following the end of the promotion. Copies of these Rules may be obtained by written request as set forth above or by visiting any participating location of the Sponsor and requesting the Rules from an authorized representative of the Sponsor.
14. Sponsor: The Sponsor of the Promotion is American Dental Solutions, 1301 Penn Ave., Wyomissing, PA 19610.
15. NON – Affiliation: American Dental Solutions is NOT affiliated with any of the social media sites used to submit an entry. Likewise, NONE of the social media sites used in submitting an entry are involved in the Promotion or affiliated with American Dental Solutions.
16. Valid Entry: A valid entry in the Promotion is accomplished by a participant posting any 1 of the following 3 social media functions and presenting it to American Dental Solutions as defined above in section 4. (How to Enter)
a. A “Check In” by the participant on an official American Dental Solutions Facebook Location Page identified by a Blue American Dental Solutions logo and the containing the correct corresponding address on the map of a participating American Dental Solutions location;
b. The participant Posting a “selfie smile” on Instagram and commenting @american_dental_ solutions in the comment section; or
c. “Tweet” on Twitter the participant’s appointment reason @AmDentSolutions. Example: (#Braces #Dentist #WisdomTeeth)

All entries must be confirmed as a valid entry by an authorized American Dental Solutions representative in order to receive a Ticket and a chance to win a prize. It is the participant’s sole responsibility to ensure he/she has complied in full with all
conditions and requirements of these Rules.
17. Invalidity. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in these Rules solely for ease of reference, and shall not be deemed to affect in any manner the meaning or intent of these Rules or any provision hereof. These Rules cannot be modified or amended in any way except in writing by a duly authorized representative of American Dental Solutions. Employees of American Dental Solutions are not authorized to modify or amend these Rules.
